Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of the Vienor platform (the "Service"), operated by Carlos Andrés Hernández, CUIT 20-29414660-2, with address in the Autonomous City of Buenos Aires, Argentina (hereinafter, "Vienor", "we"). By creating an account or using the Service, you ("the User") declare that you have read, understood and accepted these Terms in full. If you do not agree, you must not register or use the Service. This agreement is governed by the laws of Argentina, and this English version is provided for the convenience of English-speaking users; the original Spanish version governs in case of any discrepancy.

1. Service Description

Vienor is an agricultural monitoring platform that provides, among other features: per-field weather forecasts, configurable alerts based on weather conditions (frost, wind, precipitation, spray application windows, among others), satellite vegetation index (NDVI) visualization, field and plot management, and AI-assisted tools. The Service is provided under different plans (Basic, Pro, Enterprise), whose features and usage limits may vary and are detailed within the platform or in the corresponding commercial proposal.

2. Account Registration

To use the Service, you must create an account, providing truthful, complete and up-to-date information. The User is responsible for keeping their access credentials (password, second authentication factor and/or passkeys) confidential and for all activity carried out under their account. Vienor recommends enabling the two-factor authentication available on the platform. The User must immediately notify soporte@vienor.com.ar of any unauthorized use of their account.

Registration is reserved for persons over 18 years of age, or legal entities represented by someone with sufficient authority to bind them contractually. Each registered organization ("tenant") is responsible for managing the permissions and roles of the users it adds to its account.

3. Plans, Pricing and Billing

Access to certain features may be subject to payment of a periodic fee, according to the plan contracted. Current prices are provided on the platform or in the commercial proposal sent to the User and may be updated periodically; any price change will be notified with reasonable advance notice and will not affect already-paid periods. Failure to pay on time may result in suspension or downgrade of the Service to the available free plan, without prejudice to the collection of amounts owed.

The User agrees not to use the Service to:

Breach of this section may result in immediate suspension of the account, without prejudice to any applicable legal action.

5. Accuracy of Information and Limitation of Liability

The weather forecasts, alerts, NDVI indices and other information provided by Vienor are generated from third-party weather and satellite data providers (including, but not limited to, Open-Meteo and the Norwegian Meteorological Institute), processed through predictive models. Such information is estimative and informational in nature, does not constitute agronomic, technical or professional advice, and does not replace professional judgment or the User's on-site assessment of field conditions.

Vienor does not guarantee the accuracy, completeness or uninterrupted availability of such information and shall not be liable for losses, damages or harm of any kind resulting from agronomic, commercial or any other decisions made by the User based on the information provided by the Service. Use of the alerts and recommendations is the User's sole responsibility.

6. Service Availability

Vienor makes its best efforts to keep the Service continuously available, but does not guarantee a specific availability percentage. The Service may be subject to scheduled interruptions (maintenance) or unscheduled ones (technical failures, force majeure, or unavailability of external weather data or infrastructure providers).

7. Intellectual Property

All intellectual property rights over the Service, its software, design, the "Vienor" brand and associated content belong to Vienor or its licensors. The User's own data uploaded to the platform (location and geometry of their fields, notes, configurations) remains their property; the User grants Vienor a limited license to store and process such data for the sole purpose of providing the Service.

8. Personal Data

The processing of personal data carried out by Vienor is governed by the Privacy Policy, which forms an integral part of these Terms.

9. Suspension and Termination

Vienor may suspend or cancel access for a User who breaches these Terms, with prior notice when circumstances allow. The User may request account cancellation at any time by writing to soporte@vienor.com.ar. Termination does not exempt the User from payment of amounts owed up to the effective cancellation date.

10. Changes to the Terms

Vienor may modify these Terms at any time. Substantial changes will be notified through the platform or by email with reasonable advance notice. Continued use of the Service after such modifications implies acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Argentina. For any dispute arising from these Terms or from use of the Service, the parties submit to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires, Argentina, waiving any other venue or jurisdiction that might otherwise apply. Where the User qualifies as a consumer under Law No. 24,240, Argentina's consumer protection rules and territorial jurisdiction regime will apply.
